MiCA in practice: what changes for crypto-asset clients

Authorisation, transparency and complaint handling under Regulation (EU) 2023/1114.

The Markets in Crypto-Assets Regulation introduces a single European framework for crypto-asset service providers. For clients, three changes are particularly relevant.

Authorisation you can check

Service providers operating in the EU must be authorised by a national competent authority. ESMA maintains a register, which makes it easier to check whether a platform may legally offer services.

Rules on custody and conflicts of interest

Providers holding clients' assets must keep them segregated and follow rules on safekeeping. These obligations matter when a platform freezes or loses client funds.

Complaint procedures

Authorised providers must have effective and transparent complaint-handling procedures. A well-documented complaint is often the first formal step in a dispute.
